Most decisions have a 60-day deadline to appeal. However, there are some exceptions to this rule. You should read the letter you received to find out the deadline for your appeal.

There are several different kinds of appeals in Social Security cases. If your initial application was denied, you need to file a Request for Reconsideration. If your Reconsideration was denied, you need to file a Request for a Hearing. If you lost your hearing, you need to file a Request for Appeals Council Review. You can file all of these appeals online at at Appeal a decision we made | SSA.

If you received a denial from the Social Security Appeals Council, then you cannot file your appeal online with Social Security. To appeal a decision from the Appeals Council, you have to file a lawsuit in Federal District Court.

If you wish to file an appeal at any level, we recommend that you consult or retain an attorney experienced in Social Security law. Most Social Security lawyers do not charge a fee before representing you, but many will take a percentage of the lump sum benefits you receive if you win your case.

If you miss your appeal deadline, you should still file your appeal as soon as you can. Explain why you could not appeal on time and ask Social Security to accept your appeal because you had “good cause” for missing the deadline. Social Security’s online system will probably not let you file your appeal online if you missed your deadline. Instead, you can call or visit the field office nearest you to appeal past your deadline.
