This is called a Continuing Disability Review (CDR). Social Security sent your claim to a state office called Disability Determination Services, which is a division of the Louisiana Department of Children and Family Services. They will decide if you are still disabled under Social Security’s rules. Complete and return all forms they mail to you.
If possible, get a letter from your doctor(s) about your conditions, treatment, and prognosis. Answer or return any calls from DDS. If you have a copy of your medical records, send them to DDS by fax or mail. You will receive mail from DDS with the contact information for that office.
Social Security told me they decided that I am no longer disabled. What should I do?
If Social Security does a Continuing Disability Review (CDR) for your case, it will eventually send you a written decision. If SSA decides you are no longer disabled, the letter will be titled “Notice of Disability Cessation.”
You have a right to appeal this decision. In order to keep your monthly benefit payments while your appeal is pending, you must request a statutory benefits continuation (SBC) within 10 days of receiving the notice. Your request for SBC must be in writing. Visit your local Social Security Field Office to fill out Form SSA-795 to request your SBC.
If you miss the 10-day deadline to apply for SBC, SSA may still approve your request for continuing benefits while you appeal the cessation IF you show you have a good reason for the late request. You may request SBC at the Reconsideration and Administrative Hearing appeal levels.
You have 60 days to appeal SSA’s decision to stop your benefits. You can do this by filling out a Request for Reconsideration – Disability Cessation (Form SSA-789) at your local Social Security Field Office. You can find your local field office by ZIP code using Social Security’s online Field Office Locator Tool. Some Louisiana field office locations are posted at the end of this blog post.
If you miss the 60-day deadline to submit your appeal, SSA may still reconsider your claim IF you show you have “good cause” for missing the deadline. You must submit your request in writing and include supporting documentation to show why your appeal is late.
If your Request for Reconsideration is denied, you can request a hearing with an Administrative Law Judge (ALJ). SBC is not available past the ALJ appeal level.
