You may be eligible for our free legal services and can apply by calling our Covid Legal Hotline at <strong><a href=\"https:\/\/slls.org\/covid-19\/\">1-844-244-7871<\/a><\/strong> or applying online<strong> <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/lastate.kempscaseworks.com\/\">here<\/a>.<\/span><\/strong><\/h6>\n<h3><span style=\"color: #000000;\"><strong>Who does the new rule apply to?<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">Tenants, owners, and management of the following types of housing subsidized by the U.S. Department of Housing and Urban Development (HUD) \u2013<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Public Housing<\/span><\/li>\n<li><span style=\"color: #000000;\">Section 8 Project-Based Rental Assistance, including<\/span>\n<ul>\n<li><span style=\"color: #000000;\">New Construction<\/span><\/li>\n<li><span style=\"color: #000000;\">State Housing Agency Program<\/span><\/li>\n<li><span style=\"color: #000000;\">Substantial Rehabilitation<\/span><\/li>\n<li><span style=\"color: #000000;\">Section 202\/8<\/span><\/li>\n<li><span style=\"color: #000000;\">Rural Housing Services Section 515\/8<\/span><\/li>\n<li><span style=\"color: #000000;\">Loan Management Set-Aside (LMSA)<\/span><\/li>\n<li><span style=\"color: #000000;\">Property Disposition Set Aside (PDSA)<\/span><\/li>\n<li><span style=\"color: #000000;\">Rental Assistance Demonstration (RAD)<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #000000;\">Section 202\/162 Project Assistance Contract (PAC)<\/span><\/li>\n<li><span style=\"color: #000000;\">Section 202 Project Rental Assistance Contract (PRAC)<\/span><\/li>\n<li><span style=\"color: #000000;\">Section 202 Senior Preservation Rental Assistance Contract (SPRAC)<\/span><\/li>\n<li><span style=\"color: #000000;\">Section 811 Project Rental Assistance Contract<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">This rule does NOT apply to \u2013<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Section 8 Housing Choice Voucher Program (tenant-based vouchers)<\/span><\/li>\n<li><span style=\"color: #000000;\">Section 8 Project Based Voucher Program (project-based vouchers administered by a Public Housing Authority)<\/span><\/li>\n<\/ul>\n<h3><span style=\"color: #000000;\"> What does it require?<\/span><\/h3>\n<p><span style=\"color: #000000;\">On November 8, 2021 a set of new HUD regulations went into effect which require Landlords at the above properties must provide more notice to tenants before evicting them for nonpayment of rent during certain federally-declared disasters where HUD has published a determination to enforce the new rule:<em>\u00a0<\/em><\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">At least 30 days\u2019 notice must be provided for eviction for nonpayment of rent; and<\/span><\/li>\n<li><span style=\"color: #000000;\">The notice must notify tenants of available Emergency Rental Assistance, and include <em>at least<\/em> the information in the Appendix to the attached HUD Supplemental Guidance (PIH 2021-29; H 2021-06)<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">HUD published its determination that the conditions exist for the rule to go into effect <span style=\"color: #138a43;\"><a style=\"color: #138a43;\" href=\"https:\/\/www.hud.gov\/sites\/dfiles\/PIH\/documents\/PIH-2021-29.pdf\"><span style=\"text-decoration: underline;\">here<\/span><\/a><\/span>, so it is currently in effect. HUD\u2019s Interim Final Rule outlining the changes can be found <span style=\"text-decoration: underline;\"><span style=\"color: #138a43;\"><a style=\"color: #138a43; text-decoration: underline;\" href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2021-10-07\/pdf\/2021-21960.pdf\">here<\/a><\/span><\/span>.<\/span><\/p>\n<h3><span style=\"color: #000000;\"><strong>When does it go into effect?<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">The new rule went into effect on November 8, 2021.<em>\u00a0<\/em><\/span><\/p>\n<h3><span style=\"color: #000000;\"><strong>How do I know if a property is covered?<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">How do you know if a property has a subsidy covered by the new rule?
